Your use of the Victoria Nail Bar & Lash. services is subject to these Terms and Conditions. If you are not willing to be bound by each and every term or condition, or if any representation made herein by you is not true, you may not use and must cease using the Victoria Nail Bar & Lash services.
Victoria Nail Bar & Lash may modify these Terms and Conditions when Victoria Nail Bar & Lash deems it to be necessary, within the scope of the purposes of the services. In such case, Victoria Nail Bar & Lash will indicate the contents of the modified version of these Terms and Conditions, as well as the effective date of the modification, on the services or on Victoria Nail Bar & Lash website, or will publicize the same to Users by notifying Users in the manner prescribed by Victoria Nail Bar & Lash
The modified version of these Terms and Conditions shall become effective as of the effective date thereof.
1. General Terms
- Definition of Victoria Nail Bar & Lash: Victoria Nail Bar & Lash (“We”, “Us”)
- Definition of Partners Services: Services provided by the Partners as stated in section 2 below.
- Definition of Users: The users of the Victoria Nail Bar & Lash services or the purchaser of any Partner Services.
- Definition of Victoria Nail Bar & Lash Partners or Partners: The beauty Partners or businesses who are using Victoria Nail Bar & Lash as their Point of Sales software (POS) to manage their business and offer their goods and services for sale on the Victoria Nail Bar & Lash Platform.
- Definition of Platform: https://vnailbarlashcarleplace.com, including all subdirectories, subdomains, and mobile sites thereof.
- Definition of Online Payment: Payments processed through Stripe, a third-party online payment processor integrated with Victoria Nail Bar & Lash to enable Partners to collect deposits, and online gift card payments from Users. Stripe securely handles all online transactions, and the funds are deposited directly into the respective Partner’s bank account. Victoria Nail Bar & Lash does not store or control payment information. More information about Stripe’s payment processing services can be found on Stripe
- Definition of Payment Processor: The third-party payment processors supporting Victoria Nail Bar & Lash Partners with the provision of the payment services. We only support Clover Flex as an in-store payment processing device. More information can be found on Clover
2. Description of the Partner Services
Our website helps you to generate online appointments easily with a variety of participating Partners.
You understand and agree that the Partner Services listed on the Victoria Nail Bar & Lash website are provided by our Partners, and not by us. These Partners, and not Victoria Nail Bar & Lash, are responsible for User service related to these Partner Services, which includes responsibility for the nature, quality, and content of the Partner Services, as well as any disputes regarding scheduling, reservation, cancellation, refund policies, adjustments, functionality, and issues concerning experience with a Partner’s personnel or policies.
When you make an online appointment on our website, you will need to arrive at the place of business of the Partner in Appointment to receive the Partner Services.
All payments including cash, card, gift card, or others are operated in-store. We do not collect any of your payment information.
All Partner Services available for purchase on the Victoria Nail Bar & Lash website are offered by Victoria Nail Bar & Lash on behalf of its Partners. That is, Victoria Nail Bar & Lash takes and concludes your bookings as a commercial agent for its Partners. Therefore, we are not responsible or liable to you for the actual Partner Services that are booked through the Victoria Nail Bar & Lash Platform.
3. Partner Services
Our Partners are under a legal duty to provide Partner Services that are in conformity with the relevant Partner agreement.
All Partner Services shown on the Victoria Nail Bar & Lash Platform are subject to availability. The images and/or descriptions of the Partner Services on the Victoria Nail Bar & Lash Platform are for illustrative purposes only, and actual Partner Services may vary from those images and/or descriptions. We require our Partners to ensure that all information provided by them for display on their page of the Victoria Nail Bar & Lash Platform is accurate, complete, and not misleading in any way. Nonetheless, we cannot verify the information which Partners provide to us. The Partner’s responsibility is to ensure that all of its Partner Services listed on the Victoria Nail Bar & Lash Platform are available and accurately described.
It is your (or the person receiving the Partner Services of your Victoria Nail Bar & Lash appointments) sole responsibility to communicate in advance any medical or health-related conditions and/or special needs to the Partner that might affect or be affected by any Partner Services (for example without limitation, allergy information, and health issues).
4. Cancellation and No Show Policies
If you wish to cancel your Victoria Nail Bar & Lash appointment, you may do so through either the Victoria Nail Bar & Lash Platform or by contacting our Partner directly.
You may only cancel a Victoria Nail Bar & Lash appointment through the Victoria Nail Bar & Lash Platform provided that your appointment is not due to take place within a time frame (e.g., 24 or 48 hours) determined by the Partner. The interval between when you may cancel your appointment and your scheduled appointment start time will be determined independently by each Partner.
Certain Partners may choose to implement a Cancellation Policy or No Show Policy. If a Partner has such policies, then they may apply them next time when you visit the business.
5. SMS Notification Policy
By proceeding, you consent to receive SMS notifications from Victoria Nail Bar & Lash, including appointment reminders, verification codes, and feedback requests, when booking appointments with any of our Partners. These messages will be sent to the phone number provided during your registration.
You may receive the following SMS notifications from us:
- A one-time verification message.
- A reminder 24 hours or 2 hours before your appointment.
- A feedback request after your appointments.
- Up to one promotional message per month from the Partners where you have booked appointments.
To opt out at any time, reply “STOP” to any message. For assistance, reply “HELP”. Standard message and data rates may apply.
6. Users Information
When using the Dash Booking services, you may need to set up an account by registering certain information. You must register true, accurate, and complete information, and must revise the same to always keep such information up to date.
By booking an appointment with a Partner, you agree to share your personal information with that Partner. You are solely responsible for:
- Your account and its maintenance, as well as the confidentiality and security of your account and all passwords related to your account;
- Any and all activities that occur under your account, including all activities of any persons who gain access to your account with or without your permission;
- You agree to immediately notify us, to the extent that you are or become aware of any unauthorized use of your account, any service provided through your account or any password related to your account, or any other breach of security with respect to your account or any service provided through it and you agree to provide assistance to us, as requested, to stop or remedy any breach of security related to your account.
You should provide a valid mobile phone number through the Dash Booking Platform and we will verify your phone number when you register. To verify your mobile phone number, we will send you a code via text message to the mobile phone that you provided. If you change your mobile phone number, you must provide and verify your new phone number. – Dash Booking does not bear any responsibility and cannot be held liable for the verification or non-verification of a User’s identity.
7. Terms of Payments for Users
Prices and any applicable delivery and/or processing charges will be as quoted on the Dash Booking Platform. The final price you pay connected with a Victoria Nail Bar & Lash Applications may be adjusted to reflect any additional goods or services you purchase from the Partner at the time of receiving Partner Services.
All payments should be made in-store with the Partners. Thus, no binding legal contract in respect of Dash Booking online appointment is made.
The Partners will have their own Payment Processors. We only send the total amount to the payment processing device if we have integration with it and the payment will be handled by that device. Victoria Nail Bar & Lash does not collect any User payment information except payment methods such as by Cash, Card, Gift card, or Others.
Victoria Nail Bar & Lash does not add any additional fees between different payment methods.
8. Deposits and Payments
Victoria Nail Bar & Lash provides a platform for Partners to manage bookings and receive deposits from Users. When an User makes a deposit during the booking process, Victoria Nail Bar & Lash collects this payment on behalf of the Partner. All payments are processed securely through Stripe, a third-party payment processor. Funds from these payments are deposited directly into the respective Partner’s bank account, and Victoria Nail Bar & Lash does not retain or hold these funds.
9. Refund Policy
Any disputes related to deposits, cancellations, or gift card payments are strictly between the salon and the client. Victoria Nail Bar & Lash acts solely as an intermediary and is not responsible for managing or resolving refund requests.
- Partners are entirely responsible for issuing refunds in accordance with their individual refund policies.
- Victoria Nail Bar & Lash does not provide refunds for deposits or gift card payments under any circumstances.
Users are advised to contact the Partner directly for any inquiries or issues related to refunds or payment adjustments.
10. Liability Disclaimer
Victoria Nail Bar & Lash serves as a facilitator for bookings and payments and is not responsible for the services provided by Partners or the outcomes of any transactions made through the platform.
- Victoria Nail Bar & Lash disclaims all liability for disputes, claims, or financial issues arising from deposits, payments, or any other interactions between Partners and Users.
- Victoria Nail Bar & Lash does not guarantee the quality, availability, or suitability of Partners services booked through the platform.
11. Acknowledgment
By using Victoria Nail Bar & Lash’s services, both Partners and Users acknowledge and agree to the following:
- Deposits are collected and processed by Victoria Nail Bar & Lash on behalf of Partners.
- Partners are responsible for managing their deposit policies, including issuing refunds or addressing disputes.
- Victoria Nail Bar & Lash is not a party to the agreement between Partners and Users regarding services or payments and shall not be held liable for any related issues.
By proceeding with a booking, Users accept these terms and agree to address any concerns directly with the Partner.
12. Advertising
Victoria Nail Bar & Lash and the Partners will have the right, without notice, to insert advertising data into the Platform, so long as this does not involve our transmission of any of your personal information in contravention of our Privacy Statement.
13. Prohibited Users of the Services.
Victoria Nail Bar & Lash reserves the right to restrict your access partially or fully to the Victoria Nail Bar & Lash services if any of the following occur:
- You are performing or participating in any unlawful acts or to engage in acts that unrelated to the purposes of the Services;
- The number of canceled appointments, no shows, refunds, chargebacks, or other transactions by you that are negative to the experience of our Partners;
- We reasonably suspect the security of your Victoria Nail Bar & Lash account has been compromised;
- You behave inappropriately, abusively, or offensively towards the employees of Victoria Nail Bar & Lash, or employees of a Partner on any communication channels;
- We believe your actions are negatively affecting the quality of Victoria Nail Bar & Lash services.
You understand and agree that because the Partner Services are sold by our Partners, and not by us, our Partners maintain the right to impose additional restrictions on who may buy and book the Partner Services that they offer. These restrictions are determined solely by the Partners, and we are unable to provide you with access to these Partner Services.
14. Accuracy, Completeness, and Timeliness of Information
Victoria Nail Bar & Lash is not responsible if information made available on the Services is not accurate, complete, or current, including but not limited to the corporate information of a Partner, calendar availability, and bookings made as all Partners are responsible for updating their data in our system.
Notwithstanding any other provision of these terms and conditions, in no event will Victoria Nail Bar & Lash, our affiliates, or our controlling parties, agents, employees, suppliers, resellers and distributors be liable for any direct, indirect, special, incidental, consequential or punitive damages, or any other damages or losses whatsoever, including damages for loss of profits, goodwill, opportunity, earnings, use or data, arising directly or indirectly from or related to these terms and conditions or the use, or non-use of the website or any software, regardless of the cause of action and even if one or more of us have been advised of the possibility of such damages or losses, including damages or losses arising from or in any way related to the following: (i) any loss or damage to data arising directly or indirectly out of use or non-use of the website or related component; (ii) delays, errors, interruptions, mistakes, omissions, non-delivery, incorrect delivery, or defects on or related to the website. Without restricting the foregoing, if circumstances arise in which you or another party is entitled to recover damages from one or more of us, the aggregate liability of us for damages is limited to the amount paid to us by you through the website during the six-month period preceding the circumstances in which such liability arises.
